We believe in clear communication, mutual respect and an informed relationship between teacher, practitioner, creator and participant. These Terms are designed to protect your rights, respect our creative work and establish a fair understanding of what you can expect from us and what we ask of you.

Please read them carefully, particularly before making a purchase, enrolling in a programme or booking a private service.

1. About The Mind Orchestra

Throughout these Terms, "we", "us" and "our" refer to the business identified above. "You" and "your" refer to visitors, customers, clients, students, members and other users of our website or services.

2. Scope of these Terms

These Terms apply to the website at https://www.themindorchestra.com and its associated content, pages, customer areas, products and services operated by The Mind Orchestra.

This includes, where applicable:

  • Public website pages, articles, blogs and educational resources.

  • Free and paid courses, lessons, workshops and training programmes.

  • Original music, sound healing recordings, guided meditations, mantra recordings and downloadable digital content.

  • Personalised audio compositions and creative commissions, including AstroSonic products.

  • Private coaching, sound healing sessions, mentoring, consultations and online appointments.

  • The Resonance Room community, membership areas, live classes and associated resources.

  • Digital libraries, customer accounts and restricted-access learning materials.

  • Email communications, newsletters, downloadable resources and promotional offers.

  • Purchase pages, checkout systems, booking forms and related customer services.

Our website and digital services may be delivered through third-party platforms, including Kajabi and other providers.

Where we control the content or contractual offer on an associated page or service, these Terms may apply to our part of that service. Separate terms imposed by an independent platform may also apply.

These Terms do not automatically govern independently operated third-party websites or services.

Specific products, memberships, affiliate arrangements or individually agreed programmes may have additional terms. Where such terms have been provided and accepted as part of a particular purchase, they form part of the relevant agreement. In the event of inconsistency, the more specific agreed terms will apply to that product or service, subject always to applicable law.

Nothing in these Terms excludes or reduces any statutory consumer rights.

3. Accepting these Terms

By accessing or using the website, you agree to comply with the rules applicable to website use set out in these Terms.

When you purchase a product, subscribe to a membership, enrol in a course or book a service, the contractual terms applicable to that transaction will be brought to your attention during the ordering process.

A binding purchase contract is formed when your order has been accepted and confirmed by us, not merely because an item appears on our website.

We may decline an order where there is a legitimate reason, including an evident pricing error, suspected fraud, lack of availability or inability to deliver the requested service. If payment has been taken for an order we cannot accept or fulfil, we will arrange an appropriate refund.

You must be at least 18 years old to create an account, purchase our services or participate in our membership communities, unless we have expressly agreed otherwise under an appropriate separate arrangement.

4. Our approach to sound healing and contemplative practice

The Mind Orchestra provides educational, creative, contemplative and wellbeing experiences through sound, music, voice, mantra, meditation, imagination and related practices.

Our work may draw inspiration from different spiritual, philosophical, cultural and musical traditions, alongside contemporary approaches to listening, sound design and personal development.

Any discussion of healing, energy, resonance, frequency, symbolic correspondences, planetary associations or spiritual transformation should be understood in the context in which it is presented.

Where we refer to traditional beliefs, contemplative teachings, spiritual interpretations or experiential practices, these are not necessarily claims of scientifically established medical effects.

Our products and services are not intended to diagnose, treat, cure or prevent medical or psychological conditions, and should not be regarded as substitutes for appropriate professional healthcare.

We do not provide medical diagnosis, medical treatment or regulated psychological therapy unless a particular service expressly states otherwise and the relevant professional qualifications and arrangements have been identified.

Individual experiences differ. We do not guarantee particular physical, emotional, spiritual, financial, educational or therapeutic outcomes.

You remain free to interpret your experiences and decide which practices are appropriate for you.

5. Personal responsibility and safe participation

Our practices are intended to be approached with awareness, consideration and respect for individual circumstances.

You are responsible for choosing a safe environment and an appropriate level of participation.

Please take particular care when working with prolonged sound, headphones, powerful audio equipment, breathwork, movement or extended meditative practices.

Keep listening volumes at comfortable levels and stop or modify a practice if it causes discomfort.

Do not undertake immersive or attention-demanding practices while driving, operating machinery or performing activities requiring full awareness of your surroundings.

If you have a relevant health concern, are experiencing symptoms or are unsure whether a practice is suitable for you, you should seek advice from an appropriately qualified healthcare professional.

You may pause, adapt or discontinue your participation at any time.

Nothing in this section excludes our responsibility to deliver services with reasonable care and skill or affects any liability that cannot lawfully be excluded.

6. Website information and educational content

We aim to provide clear, useful and accurate information throughout our website.

Our articles, recordings, blog posts, lessons and educational materials may include practical guidance, personal experience, artistic interpretation, historical information or discussion of developing research.

Some content reflects particular traditions or the creator's interpretation and may not represent universal agreement or established scientific conclusions.

We make reasonable efforts to keep important information accurate and up to date. However, general informational materials may change over time, and historical or archived material may not reflect current understanding.

You should exercise your own judgement when applying educational information to your circumstances.

Any information forming part of a product description or contractual commitment remains subject to your applicable statutory rights.

7. Intellectual property and copyright

Unless expressly stated otherwise, the original content produced and made available by The Mind Orchestra is owned by The Mind Orchestra or used under an appropriate licence.

This includes, without limitation:

  • Original music, sound recordings, compositions, soundscapes and productions.

  • Guided meditation recordings, scripts and spoken-word works.

  • Original illustrations, artwork, designs, graphics and visual materials.

  • Educational materials, course recordings, lesson texts and written resources.

  • Original teaching documents, workbooks, diagrams and creative frameworks.

  • Website design elements, branding, logos and original promotional materials.

  • Original combinations, arrangements and recordings of sound healing, musical and contemplative practices.

Copyright in pre-existing traditional texts, public-domain materials, historical practices and third-party works remains subject to the applicable rights of their respective creators or owners.

Purchasing or accessing content does not transfer copyright or other intellectual property rights to you.

Unless a product expressly includes additional rights, we grant you a limited, personal, non-exclusive, non-transferable licence to access and use the relevant content for its intended purpose.

You may listen to purchased recordings, study educational materials and use the knowledge and general techniques you learn in your own personal or professional practice, subject to any clearly disclosed course-specific restrictions.

Without prior written permission, you must not:

  • Redistribute, upload, sell or commercially licence our recordings or teaching materials.

  • Reproduce substantial portions of our copyright-protected works for public distribution.

  • Present our original recordings, scripts, artwork or other protected materials as your own creations.

  • Make our paid resources publicly accessible or share access credentials with others.

  • Use our recordings as components of commercial releases, products, classes or public broadcasts unless the applicable licence permits this.

  • Use our protected content to build commercial content databases or train artificial intelligence systems without an appropriate licence, except where permitted by law.

Nothing in this section restricts rights granted by copyright law, including applicable statutory exceptions.

If you would like to license music, incorporate a recording into your professional work or collaborate on a commercial project, please contact us to discuss written permission.

8. Digital products, recordings and downloads

Our digital products may include downloadable audio, streamed music, meditation recordings, guided practices, courses, written learning materials, artwork and other electronic resources.

The individual product description will explain, as applicable, what is included, how the content is supplied, whether it can be downloaded or only streamed, and any material access restrictions.

Where relevant, we will provide information about technical requirements, formats, compatibility and access arrangements before purchase.

You are responsible for ensuring that your device and internet connection meet the stated requirements.

We will take reasonable care to supply digital content as described and in accordance with your statutory rights.

Access periods are governed by the terms of the particular product. A product described as offering access for a specified period will be supplied on that basis.

Unless expressly promised, access to a product or membership should not be assumed to continue indefinitely.

If digital content is faulty, not as described or otherwise fails to meet applicable legal standards, you may be entitled to a remedy under the Consumer Rights Act 2015.

9. Courses, workshops and educational programmes

Our educational offerings may include self-paced courses, live instruction, recorded lessons, downloadable materials, community participation and additional teaching resources.

Each course or programme description will specify its principal features, price, delivery format and any important restrictions.

Unless expressly stated otherwise:

  • Enrolment provides access only to the programme and resources included in the purchased offer.

  • Course materials are supplied under the personal-use licence described in these Terms.

  • Participation does not automatically confer professional accreditation, certification, permission to teach proprietary materials or endorsement by any external professional body.

  • Any certification or completion award will be described separately where offered.

  • Live participation opportunities may be subject to scheduling, capacity and reasonable participation rules.

We may make reasonable improvements to course materials or delivery arrangements.

Where a material change affects an agreed paid service, we will explain the change and provide an appropriate remedy where required by law.

10. Private coaching, sound healing sessions and mentorship

Our private services may include individual sound healing coaching, voice and mantra instruction, creative consultation, Reiki-related practices, professional development and extended mentorship.

The nature, duration, delivery method, number of appointments and included support will be specified in the relevant service description or written agreement.

These are professional educational, creative and contemplative services. They do not establish a medical, psychiatric or psychotherapeutic relationship.

For private programmes, we may agree individual objectives, delivery arrangements, support boundaries and practical requirements before services begin.

You agree to provide accurate information reasonably necessary for the provision of your chosen service and to communicate respectfully throughout our working relationship.

Where a programme includes between-session communication, feedback or aftercare, the extent and availability of that support will be governed by the purchased offer or individually agreed programme terms.

Such support is not an emergency response service and should not be relied upon as continuous or immediate personal assistance.

We will provide our services with reasonable care and skill, in accordance with applicable consumer law.

11. Appointments, rescheduling and missed sessions

Booking arrangements will be explained in the applicable offer, booking confirmation or individual service agreement.

If you need to change an appointment, please contact us or use the booking system as soon as reasonably possible.

We will make reasonable efforts to accommodate rescheduling requests, taking account of availability, the timing of the request and any specific booking conditions disclosed before purchase.

Any cancellation, missed-appointment or late-rescheduling charge must be fair, proportionate and consistent with applicable consumer law.

Where such a charge applies, it must have been clearly explained before the relevant booking was made and must not amount to an unfair penalty.

If we need to cancel an appointment, we will offer a suitable alternative wherever reasonably possible.

If we cannot provide an agreed paid service and a suitable alternative cannot be arranged, you will be entitled to an appropriate refund or other remedy as required by law.

For session bundles and mentorship programmes, any scheduling periods, appointment validity or expiry dates must be stated in the offer or separately agreed. No undisclosed expiry period is imposed by these general Terms.

12. Personalised soundscapes and commissioned creative work

We may offer bespoke creative services, including personalised audio compositions, AstroSonic recordings, symbolic artwork and individually commissioned soundscapes.

These services may involve an initial consultation or intake process, research, creative development, recording, editing, production and electronic delivery.

The applicable offer will describe the principal deliverables and any agreed completion timeframe or delivery estimate.

Where creative work depends upon information supplied by you, you agree to provide accurate and reasonably complete details.

We will use reasonable care and skill when preparing a commission.

Unless additional rights are expressly granted in writing, purchasing a personalised composition gives you the right to use and enjoy the completed materials for their agreed purpose, but does not transfer ownership of the underlying copyright.

The symbolic, astrological, spiritual or contemplative elements of a commission are artistic and interpretative in nature. They are not guarantees of future events or particular personal outcomes.

Any cancellation rights applicable to commissioned services or electronically supplied digital content are governed by section 15 below and the law. The fact that an audio recording is personalised does not, by itself, remove all statutory cancellation rights.

13. The Resonance Room and community participation

Our membership and community services may provide access to discussion spaces, shared practice, educational resources, live gatherings, recordings and other member benefits.

We ask all participants to contribute to a respectful and welcoming environment.

You must not:

  • Harass, threaten, intimidate or deliberately abuse another participant.

  • Publish unlawful, hateful, discriminatory or seriously offensive material.

  • Share another member's private information without permission.

  • Distribute malicious links, spam or unauthorised advertising.

  • Infringe intellectual property rights.

  • Record or publicly distribute private group sessions or conversations without appropriate consent.

  • Misrepresent your identity or professional qualifications.

  • Use the community to exploit vulnerable individuals or make misleading therapeutic claims.

You are encouraged to respect the confidentiality of personal experiences shared by others.

However, community spaces may involve interaction between independent participants, so we cannot guarantee that every other member will maintain confidentiality.

Please avoid sharing sensitive information that you would not wish other members to see.

We may moderate or remove material, issue reasonable warnings or restrict access where necessary to maintain safety, protect participants or enforce these Terms.

Any suspension or termination will be considered fairly and proportionately, having regard to the circumstances, the seriousness of the conduct and your contractual and statutory rights.

14. Memberships, recurring payments and instalment plans

Some products or services may be offered through recurring memberships, fixed-term programmes or scheduled instalment payments.

These arrangements are not necessarily equivalent.

Recurring memberships

Where an offer involves recurring payments, we will explain the billing frequency, price, duration, included benefits, renewal arrangements and cancellation method before purchase.

You may cancel future automatic renewals using any self-service cancellation facility provided or by contacting us at themindorchestra@gmail.com.

We will not require an unreasonable or unnecessarily difficult cancellation process.

Unless applicable law or a more favourable specific offer provides otherwise, cancelling renewal normally allows access to continue until the end of the current paid period.

Any refund entitlement will be determined by the applicable consumer rights, the particular membership agreement and the circumstances of cancellation.

We will explain any material changes to membership prices or terms in advance where required, and obtain consent where necessary rather than applying an unagreed price increase.

Instalment plans

An instalment plan may simply divide the total purchase price of a fixed programme or service into several scheduled payments.

Unless the specific offer provides otherwise, paying by instalments does not create additional sessions, increase the purchased entitlement or turn a fixed-price programme into a cancellable monthly membership.

The full price, number of instalments, payment amounts and payment schedule will be disclosed before purchase.

Your right to cancel a contract, dispute an incorrect charge or obtain a refund remains governed by applicable law and the terms of the particular agreement.

Cancelling a card authorisation or payment method does not, by itself, cancel a valid underlying purchase contract.

We will not seek payment for services that we are not legally entitled to charge for, and we will assess any outstanding balance fairly where a contract is lawfully cancelled or terminated.

15. Consumer cancellation rights and refunds

We want our purchase arrangements to be clear and fair.

If you are purchasing as a consumer, you may have statutory cancellation and refund rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015.

The rights available depend on the type of product or service, how the contract was made, when performance begins and any applicable statutory exceptions.

15.1 Services purchased at a distance

For most eligible services purchased online or otherwise at a distance, you have a legal right to cancel within 14 days after the day on which the contract is entered into, without giving a reason.

If you expressly request that we begin providing the service within this cancellation period, you may be required to pay a proportionate amount for services supplied before cancellation, provided the legal requirements for early performance have been met.

If the service has been fully performed during the cancellation period following your express request and the required acknowledgement, the statutory right to cancel may end once performance is complete.

These rules do not remove any separate rights you may have where a service is not delivered with reasonable care and skill.

15.2 Downloadable and streamed digital content

For eligible digital content not supplied on a physical medium, there is generally a 14-day statutory cancellation period beginning the day after the contract is entered into.

Where you expressly consent to immediate digital supply during that period and acknowledge that you will lose your statutory cancellation right once supply begins, that cancellation right may end when supply starts, provided the applicable legal requirements are satisfied.

We must obtain the necessary consent and acknowledgement and provide the required confirmation.

Simply describing a digital product as non-refundable does not remove statutory cancellation rights.

If the legal requirements for ending cancellation rights have not been met, your statutory rights remain unaffected.

15.3 Personalised commissions

Personalised soundscapes and other commissioned works may involve both creative services and digital content.

The applicable cancellation position will depend on the nature of the contract, the stage of performance or delivery, the consents obtained and the relevant legal rules.

Any charge for creative services already supplied during a valid cancellation period will be assessed according to the applicable statutory requirements.

We will not rely on a blanket no-refund provision merely because a commissioned product is unique or personalised.

15.4 Live events and dated bookings

Certain contracts for leisure activities scheduled for a specific date or period may be exempt from the usual statutory cooling-off rules.

Where an exemption genuinely applies, we will explain the relevant booking and cancellation conditions before purchase.

Otherwise, the applicable statutory cancellation rights remain available.

Any additional cancellation fees must be fair and legally enforceable.

15.5 Faulty or misdescribed products and services

Your statutory rights remain available if digital content is faulty, a service has not been performed with reasonable care and skill, or a product or service does not meet applicable legal requirements.

Nothing in these Terms prevents you from seeking a legally available repair, replacement, repeat performance, price reduction, refund or other remedy.

15.6 Requesting cancellation

To exercise a statutory cancellation right, please contact:

themindorchestra@gmail.com

You may use the model cancellation form at the end of these Terms, but you are not required to use that form. Any clear statement communicating your decision to cancel is sufficient.

Where a refund is due, we will make it without undue delay and within the period required by law, normally within 14 days of receiving your valid cancellation notice for a service or digital-content contract.

Refunds will ordinarily be made using the original payment method unless another arrangement is agreed.

16. Prices, payment and billing

Prices for our products and services will be displayed in the applicable product description or checkout.

We will provide the total payable price, including applicable taxes and mandatory charges, before you place an order.

Where a price cannot reasonably be calculated in advance, we will explain how it will be calculated.

We may change our published prices for future purchases or enrolments.

A price change will not retrospectively alter an existing agreed purchase or a protected legacy arrangement unless a valid contractual basis and applicable law permit that change.

We may use third-party payment processors to securely facilitate transactions.

You agree to provide accurate billing and contact information and to keep relevant account details up to date.

If a payment fails, we may contact you to resolve the issue and, where permitted by the agreement and applicable law, suspend access to the affected unpaid service after reasonable notice.

We will not knowingly impose undisclosed mandatory charges.

17. Customer accounts and access security

Some services require an individual account.

You are responsible for maintaining the confidentiality of your login credentials and taking reasonable steps to prevent unauthorised access.

You must not share paid account access with other people unless the particular service expressly permits this.

Please inform us promptly if you believe your account has been compromised.

We may take reasonable security measures, including temporarily restricting access where necessary to investigate suspected misuse or protect accounts.

Where account restrictions affect paid services, we will act fairly and consider your contractual and statutory rights.

You may request account closure by contacting us. Closure of an account does not automatically cancel a separate ongoing payment obligation or subscription; these should also be cancelled through the relevant process.

Our handling of personal information associated with accounts is explained in our Privacy Policy.

18. User submissions, feedback and testimonials

You may be able to submit comments, questions, course feedback, community posts, reviews, images, recordings or other materials.

You remain responsible for ensuring that you have the necessary rights and permissions to submit content.

You retain ownership of any copyright that you hold in your own original submissions.

By submitting content to a community
